Mediation and Arbitration

Alternative Dispute Resolution (ADR) gives parties the opportunity to resolve their disputes outside of the courtroom. Courts of Southwest Florida encourage (and frequently order) the parties to participate in ADR. This can come in the form of Mediation, Arbitration, or a Hybrid.


Mediation allows parties to retain control over the outcome of the case. The confidential process allows each side in a dispute to hear and assess the views of the other side. The mediator acts as a neutral facilitator in negotiations, attempting to help parties reach a desirable resolution. The parties decide whether a case settles. Mediation can take place while a case is in suit or even before any suit is filed to resolve a dispute that looks like it may otherwise end up in litigation.


Arbitration allows parties to present their positions, evidence, and arguments to a neutral third party. The arbitrator then issues a decision on the merits of the case. Most often this decision is not binding but gives the parties the opportunity to understand how an independent decision maker views their case. 


Hybrid, is a combination of these approaches. The parties present their positions and evidentiary support. A mediation is then conducted. If the matter does not settle, the neutral makes a decision as arbitrator.

We can handle real estate closings as the closing agent, and we are a licensed title agency and can issue title policies. We also assist other title agencies with their legal needs for their own real estate transactions, including drafting or reviewing documents to help ensure a smooth transaction. 


We also assist individuals with the purchase and sale of properties. From negotiations to contract to drafting documents to closing, we can explain the process and protect your interests. Proper representation in cooperation with the parties contributes to a smooth transaction and ensures that any wrinkles are ironed out before they become problems.  


We also represent clients with concerns after the closing. This sometimes means negotiation and sometimes litigation. This can include problems where construction does not go as planned, such as lien, defect or contractual disputes. 


We have represented developers, general contractors, subcontractors, businessowners, and homeowners in real estate and construction-related issues. Terry has served as general counsel for contractors. We can help you with the development of new projects if you are in the trade.

Monica and Terry have over 40 years of combined legal experience. We both came to Southwest Florida because it is a beautiful place to raise our families. We are here to help your family or your clients when you need it.

Monica and Terry have over 40 years of combined experience in litigation. With this experience, they offer exceptional service assisting clients reach resolutions. They offer alternative dispute resolution for litigants, offering both mediation and arbitration services. They also offer assistance with real estate related matters.  

Monica Schmucker

Partner
Monica is a Florida Supreme Court Certified Circuit Court Civil Mediator and a Qualified Arbitrator, and she dedicates her practice to alternative dispute resolution and real estate transactions. She has a background as a litigator in both the defense and plaintiff side of personal injury, negligence, premises liability, auto accidents, property damage, and third party and first party insurance claims. Before law school, Monica taught English at both Miami Dade County Public Schools and Miami Dade College until she relocated to Indiana to attend law school at the University of Notre Dame. While in law school, she worked at the Notre Dame Legal Aid Clinic helping clients in cases involving mortgage foreclosure and real estate fraud issues. After law school, Monica clerked for Judge Kathleen Lang in LaPorte County Superior Court and later joined the Office of the Indiana Attorney General as a Deputy Attorney General in the Licensing Enforcement and Homeowner Protection Unit. She then began practicing insurance defense litigation until relocating to Southwest Florida, where she continued as a litigator on both the defense and plaintiff side before deciding to focus on alternative dispute resolution and real estate transactions. Monica also serves as the Special Magistrate for the Town of Fort Myers Beach. Monica is originally from Miami, Florida, and is fluent in Spanish. When not working, Monica enjoys canoeing, kayaking, paddleboarding, and reading a good book on the beach with her husband, son, and daughter. Monica devotes countless hours to the Fort Myers Beach community, including serving as Past President and current board member of the Fort Myers Beach Woman’s Club. She is a proud member of the Notre Dame Club of SWFL, served as Chair of the Fort Myers Beach Nuisance Abatement Board, and is also past-treasurer and advisor for the board for Friends of Lovers Key (“FOLKS”). Monica is also a member of the Calusa Inn of Court. In 2020, Authority Magazine featured Monica in the article: “How Attorney Monica Schmucker Tackles The Extreme Work Life Balance Of Being A Woman Business Leader During Covid-19.” In years 2021-2024, Monica was recognized by Best Lawyers: Ones to Watch® in America. After Hurricane Ian devastated Fort Myers Beach, Monica served as a member of the ad hoc committee working with the Lee County School District to come up with a plan for rebuilding Fort Myers Beach Elementary School and worked tirelessly in the efforts to save their school.

Terry has been a Florida Bar Board Certified Construction Law Specialist since 2015. He also is a Supreme Court Certified Mediator for Circuit Court Matters and a Qualified Arbitrator for Florida Courts. Terry came to Southwest Florida in 2005 - just in time to experience Hurricane Wilma. Arriving in Fort Myers, he joined a major litigation firm, where he honed the local art of lititigating, bodily injury, employment and contractual disputes. Property-related matters caught his attention in two ways: insurance claims and construction disputes. He developed his specialty in construction by dedicating much of his efforts in that realm. These disputes sometimes dealt with bodily injury but more often were related to damage to homes, condominiums and sometimes whole communities. He has represented homeowners and also everything from sub-subcontractors on up to developers. He has represented homeowners, insurers and served as corporate counsel to local trade specialists. Before moving to Florida, Terry learned property law and litigation skills in Philadelphia and Southern New Jersey, where he practiced for 12 years. This included representation related to the purchases, financing of real property and zoning and land use. Later, he expanded into litigation including disputes over contracts and construction financing for the City of Camden New Jersey. Here, he was honored to be chosen to represent the City in trial and appellate courts, including the New Jersey Supreme Court. On a more personal note, Terry moved his family to Southwest Florida where extended family already lived. He is a father to three children who had the chance to grow in this community with family around them. Although the kids are grown now, it was his great joy to see them thrive in sports (he coached) and school. He is a fantasy footballer and an unfortunate golfer. He is also frequently found on stage in community theaters in Southwest Florida. Most recently, he was Santa (the real one) in Elf for Christmas.
